Legal Expert Analyzes High Court Judgment in Daddy Lumba Case


Legal practitioner Samuel Kissiedu has described the recent High Court ruling involving Highlife icon Daddy Lumba and Akosua Serwaa as a well-founded decision, emphasizing that the judgment was primarily driven by technical legal considerations.


In an interview with Nana Romeo on Okay FM, Kissiedu explained that the case raised multiple legal issues, including inheritance rights, the classification of marriages, and the application of laws from various jurisdictions concerning Ghanaians married abroad. He noted that these interconnected issues required the court to carefully examine both legal nuances and the evidence presented.


"Lumba's case involved several complex legal questions, such as inheritance, succession, and conflicts of law," Kissiedu said. "It’s a significant and thought-provoking judgment."


Kissiedu went on to explain that the ruling was difficult to contest because it was based on technical deficiencies rather than the substantive claims of either party. “I’ve reviewed the case thoroughly, and the judgment appears solid. Ultimately, it was the technicalities that led to Akosua Serwaa’s unfavorable outcome,” he noted. "I'm uncertain why this happened, but the judgment is sound."


The legal expert suggested that the rapid pace of the trial may have hindered the plaintiff’s legal team from addressing crucial documentation issues, which were raised at the beginning of the proceedings. "Perhaps the speed of the trial affected their ability to rectify issues with their paperwork. After the court rejected the injunction, it became clear that there were problems with the marriage certificate,” Kissiedu said.


He pointed out that the court had expected these documentation issues to be addressed prior to trial. “They were supposed to authenticate the documents and provide true copies, but that was not done in time,” he added.


Kissiedu also highlighted that the judgment provided much-needed clarity on the different types of marriages recognized under Ghanaian law and their impact on succession rights.


In conclusion, Kissiedu stated that while the ruling was conclusive, it offered valuable lessons for future cases. "The outcome is final, but there are important takeaways. The judge also provided useful insights on the legal classifications of marriages," he concluded.
