Cybersecurity expert Richard Kumador has sharply criticized alleged cyber fraud suspect, Abu Trica, for engaging with investigators without the presence of his lawyer. Kumador emphasized that, in such circumstances, the suspect should have remained silent until legal counsel was available.
In an interview on Sompa FM, Kumador expressed his concern over Abu Trica’s decision to speak after initially stating he would not respond until his lawyer arrived. Kumador explained that no suspect is legally obligated to answer questions from investigators once they invoke their right to legal representation. "Just because investigators continue to ask questions doesn’t mean you have to answer," Kumador stated. "It is the suspect’s responsibility to remain silent."
He also pointed out the broader issue of public ignorance regarding basic legal rights in Ghana, urging for increased public education on the matter. According to Kumador, suspects are under no obligation to answer any questions upon arrest, and should instead wait until they have spoken privately with their lawyer.
Kumador went on to advise that even if a lawyer is present, suspects should refrain from speaking unless their lawyer explicitly advises them to do so. He stressed the importance of carefully considering every response in legal matters.
Drawing a contrast with the arrest of Twum Barimah, Kumador praised his decision to remain silent, calling it the correct legal approach. In comparison, he argued that Abu Trica, as a suspected cyber fraudster, should have refrained from speaking altogether.
