The Koforidua High Court has dismissed a parliamentary election petition filed against the Member of Parliament for the Suhum Constituency, Frank Asiedu Bekoe, popularly known as Protozoa, citing a lack of credible evidence to support the claims.
In its ruling delivered on Thursday, December 18, 2025, the court held that the petitioners failed to establish a prima facie case capable of justifying the reliefs sought. The court noted that the allegations contained in the petition were not backed by sufficient or convincing evidence.
“The petitioners have failed to produce credible evidence in support of the allegations contained in the petition,” the court ruled.
The petition was filed by Kwadjo Asante following the 2024 parliamentary elections and sought to challenge the validity of Mr. Asiedu Bekoe’s election. However, the court observed that under cross-examination, the petitioners were unable to substantiate any of the material claims raised.
According to the court, “the evidence placed before this court does not disclose any basis upon which the election of the respondent can be annulled.”
As a result, the court dismissed the petition in its entirety, describing it as unmeritorious and unsupported by evidence.
Subsequently, counsel for the respondent applied for an award of costs and damages, arguing that the petition had unnecessarily prolonged litigation and caused financial and emotional hardship to the respondent. Although GH¢500,000 was requested, the court exercised its discretion and awarded GH¢200,000 in costs and damages in favour of Mr. Asiedu Bekoe.
“The award of costs is intended to compensate the respondent for the inconvenience and expense occasioned by this action,” the court stated.
The ruling effectively affirms Frank Asiedu Bekoe as the duly elected Member of Parliament for the Suhum Constituency.
