Private legal practitioner Martin Kpebu has outlined the legal basis for his petition to remove Special Prosecutor Kissi Agyebeng, asserting that the law provides sufficient grounds for such action.
Speaking on the *KSM Show*, Kpebu referred to Section 15 of the Office of the Special Prosecutor (OSP) Act, which highlights several grounds for removal, including misbehaviour, incompetence, breach of the oath of secrecy, and conduct likely to bring the office into disrepute.
“These are clearly defined statutory categories,” Kpebu stated. “My petition will address some of these grounds, though not all.”
He clarified that his concerns go beyond corruption allegations, pointing to issues of incompetence, misbehaviour, and integrity.
Kpebu revealed that sixteen petitions have already been filed against Agyebeng, adding, "Mine will be the seventeenth unless another citizen submits one first."
The lawyer argued that statements made by the OSP leadership regarding security agencies fall under provisions that could damage the office’s reputation. “You cannot misrepresent agencies like the National Intelligence Bureau (NIB) and expect no consequences,” Kpebu stated.
He also criticized Agyebeng’s refusal to acknowledge errors, stating, "If he had apologized just two or three days after the interview, the matter would have blown over. Humility is key in public office."
Kpebu emphasized that he will present evidence at the appropriate forum, stating, “If the right conditions are met, I will submit all the necessary documentation.”
