Torkornoo’s Removal: A Critical Precedent for Future Chief Justices


 

In a recent interview on TV3's KeyPoints on Saturday, September 6, private legal practitioner Martin Kpebu asserted that the removal of former Chief Justice Gertrude Torkornoo serves as a crucial wake-up call for future heads of the judiciary in Ghana. He emphasized that the incident sets a new precedent, highlighting the importance of adhering strictly to due process in judicial conduct.

Kpebu noted that her removal will profoundly influence how future Chief Justices conduct themselves, with the next appointee being particularly cautious in following due process to avoid a similar fate. "No Chief Justice will want to go through what Gertrude Torkornoo experienced, and as a result, they will be much more careful," Kpebu remarked.

Torkornoo's removal has sparked national debate following President John Dramani Mahama's decision to dismiss her from office. The dismissal came after an Article 146 Committee report found her guilty of financial misconduct, including the misuse of public funds for personal trips. The controversy surrounding her removal has also been fueled by new revelations regarding behind-the-scenes negotiations prior to her departure.

Abraham Amaliba, a member of the National Democratic Congress (NDC) legal team, disclosed additional information during the same program. He explained that Torkornoo initially sought a retirement arrangement with full entitlements before pursuing legal action. Amaliba revealed that two eminent persons in the country were involved in trying to broker this deal on her behalf. However, when discussions were still ongoing, Torkornoo took legal action to contest her removal process.

As the debate continues, many are watching closely to see how this case will affect the behavior of future judicial leaders and the overall integrity of Ghana's judiciary.
