Chairman of the Constitution Review Committee (CRC), Professor Kwasi Henry Prempeh, has clarified that proposals to extend Ghana’s presidential term from four to five years will not affect the current president.
Speaking in an interview with JoyNews, monitored by *MyNewsGh*, Prof Prempeh stressed that constitutional provisions cannot be altered after an election has been conducted, and therefore any approved amendment would only take effect in future electoral cycles.
“It is not possible,” he stated. “The president was elected under a constitution that provides for a four-year term. You cannot change his mandate midstream.”
He explained that although the committee initially considered including a specific clarification in its report, it ultimately decided against it.
“In an earlier draft of the report, we stated clearly, for the avoidance of doubt, that the proposal would take effect after the current term,” he said.
However, Prof Prempeh noted that the wording was later removed to avoid creating confusion or unintended interpretations.
“Some felt that if we made that clarification only in relation to this recommendation, it might suggest that the other proposals would take effect immediately. So we decided to leave it out,” he explained.
Despite the absence of explicit wording, Prof Prempeh maintained that the legal position remains clear, emphasising that constitutional amendments cannot be applied retroactively to alter the terms under which an officeholder was elected.
