Philadelphia has agreed to a $3 million settlement with the family of Thomas "T.J." Siderio, a 12-year-old boy who was fatally shot in the back by a police officer in 2022. The settlement resolves a federal lawsuit filed by the Siderio family in January 2024, which accused the city and the involved officer of executing their son and highlighted systemic failures within the police department.
The Incident
The fatal shooting occurred in March 2022 when four plainclothes Philadelphia police officers in an unmarked vehicle attempted to stop Siderio and a 17-year-old companion. According to grand jury findings, officers believed the older teen may have had a loose connection to a stolen firearm investigation.
As the officers activated their vehicle’s emergency lights, a gunshot shattered the rear passenger window of their car, injuring one officer with glass. The grand jury concluded that Siderio had likely fired a shot into the vehicle as it approached.
In response, the officers sought cover while one of them, Officer Edsaul Mendoza, pursued Siderio on foot. The grand jury later described Mendoza’s pursuit as "tactically unsound." During the chase, Siderio discarded a firearm. Despite this, Mendoza fired two additional shots, including a fatal shot to Siderio’s back from less than 10 feet away, killing him within 90 seconds.
Evidence presented in court showed Mendoza was aware that Siderio no longer had a weapon when he fired the final shot.
Legal Consequences and Lawsuit
Following the incident, Mendoza was terminated from the Philadelphia Police Department. A grand jury recommended charges including first-degree murder, third-degree murder, voluntary manslaughter, and possession of an instrument of crime. In 2024, Mendoza pleaded guilty to third-degree murder and possession of a weapon, receiving a sentence of 8 to 20 years in prison.
The Siderio family’s lawsuit described the shooting as "execution-style" and criticized what they called a "systemic policy failure." The case was resolved before reaching trial through negotiations involving a private mediator.
Family’s Statement
Michael Budner, the attorney representing the Siderio family, emphasized that the settlement, while significant, could not replace the life of their child.
“Obviously, this lawsuit is only one component of their grief journey,” Budner told USA TODAY. “Certainly, this somewhat brings some semblance of justice to the family and to T.J.'s honor. But as you can imagine, nothing will bring back their child.”
Philadelphia District Attorney Larry Krasner underscored the importance of equal accountability under the law in a public statement after Mendoza's guilty plea, stating, “Justice must be even-handed. Everyone must be accountable under the law.”
Representatives for the city and Mendoza’s attorney declined to comment further on the settlement.
