Former Chief Justice, Justice Gertrude Torkornoo, has filed a judicial review application at the High Court contesting her removal as a Justice of the Supreme Court by President John Dramani Mahama.
In her suit, Justice Torkornoo argues that her dismissal was unconstitutional. According to her, the recommendation for her removal was based on her position as Chief Justice, which follows a distinct constitutional procedure from that of removing a Justice of the Supreme Court.
Reliefs Sought
Justice Torkornoo is seeking the following reliefs from the court:
- An order of certiorari to quash the removal warrant issued by President Mahama on September 1, 2025, on grounds that it violated the constitutional procedure outlined for removing Justices of the Superior Courts.
- A declaration that the President does not have the authority to remove a Justice of the Superior Courts unless the process strictly complies with Article 146 of the 1992 Constitution.
The case raises significant constitutional questions about the separation of powers, the independence of the judiciary, and the proper procedures for the removal of high-ranking judicial officers in Ghana.
