Former Special Prosecutor Martin Amidu has strongly criticized High Court Judge Samuel Bright Acquah, accusing him of using bail decisions as a tool to punish accused persons and win approval from political leaders.
Referring specifically to the recent bail case involving Abronye DC, Amidu argued that the judge behaved as though the accused was already guilty, despite a plea of not guilty.
“The presumption of innocence was asserted by the suspect by his plea of not guilty… Judge ‘Napoleon’ Samuel Bright Acquah had no business, as a professional judge, to lecture the suspect or Ghanaian citizens on their fundamental rights,” Amidu wrote.
He went further to draw parallels with another recent case, Rep v Emmanuel Kwakye, where Judge Acquah similarly remanded the accused for two weeks, despite a not-guilty plea. According to Amidu, this reflects a disturbing pattern of so-called "equalizing" rulings to gain political goodwill.
“Remanding suspects who have pleaded not guilty, especially in cases involving alleged insults to the President, is nothing short of a preliminary punishment before trial. It’s a clear abuse of the fundamental rights and freedoms of the citizen,” Amidu stated.
This is not the first time Martin Amidu has raised concerns about the conduct of Judge Acquah. He has previously accused the judge of undermining judicial integrity and eroding public trust in Ghana’s justice system.
