The Accra High Court has struck out a lawsuit filed by Ernestina Fosuh and other members of the maternal family of the late highlife legend, Charles Kwadwo Fosuh, popularly known as Daddy Lumba, against the family head, Abusuapanin Kofi Owusu.
The case, which was initiated in December 2025, sought to halt preparations for Daddy Lumba’s funeral and accused Abusuapanin Kofi Owusu of marginalising some family members and withdrawing funds from a memorial account without their consent. Other defendants named in the suit included Transitions Funeral Home and CAL Bank.
The plaintiffs in the matter were Obaapanin Afia Adomah, Robert Gyamfi (also known as Wofa Yaw Poku), Georgina Gyamfi, Ernestina Fosuh, and Nana Afia Kobi. They argued that they had been excluded from key decisions regarding the funeral arrangements of their late relative.
On December 12, 2025, the Accra High Court initially granted an application for an interlocutory injunction to stop the funeral, which was scheduled for December 13. However, the court subsequently ordered the plaintiffs to provide a GH₵2 million guarantee within two hours. When they failed to meet this requirement, the injunction was lifted, allowing the funeral to proceed. The court then adjourned the case to January 15, 2026, to address the remaining issues.
At the resumed hearing on January 15, 2026, the plaintiffs failed to appear in court. Lawyers representing the defendants therefore applied for the case to be dismissed, a request the trial judge granted. As a result, the lawsuit was formally struck out.
The ruling marks another legal victory for Abusuapanin Kofi Owusu and Daddy Lumba’s widow, Odo Broni, who have consistently prevailed in the series of court disputes that have followed the death of the celebrated musician.
The dismissal has generated widespread public reaction, particularly on social media, where many observers have commented on the outcome and expressed varied opinions on the ongoing family disagreements surrounding Daddy Lumba’s legacy.
The legal battles form part of broader tensions within the late musician’s extended family, including disputes over funeral arrangements, property, and customary responsibilities. Despite these challenges, the court’s latest decision brings an end to this particular suit and reinforces earlier rulings in favour of Abusuapanin Kofi Owusu.
