Akosua Serwaa Files Appeal, Challenges Kumasi High Court Ruling


 

Madam Akosua Serwaa, the first wife of the late Ghanaian highlife legend Daddy Lumba, has filed a notice of appeal against the judgment delivered by the Kumasi High Court on November 28, 2025, describing the decision as unfair and unjust.

According to court documents that have surfaced online, Madam Serwaa expressed strong dissatisfaction with the ruling, which dismissed key evidence she presented to support her claims. She contends that the court wrongfully rejected her marriage certificate, which was tendered as exhibits B, B1, and B2, despite its relevance to the case.

The notice of appeal, filed at the Court of Appeal in Kumasi, argues that the trial judge erred in law by holding that the marriage certificate was not admissible on its own merits. She further maintains that the court was wrong to insist that Section 161 of the Evidence Act was a condition precedent before any weight could be attached to the admitted document.

Madam Serwaa also challenged the court’s assessment of credibility, stating that the judge wrongly preferred the defendants’ evidence over hers.

She is therefore seeking an order from the Court of Appeal to set aside the entire judgment of the Kumasi High Court and to enter judgment in her favour.

The appeal affects several parties named in the case, including Priscilla Ofori, popularly known as Odo Broni—Daddy Lumba’s second wife—and Transitions Funeral Home, also known as Enterprise Funeral Services, located at Abrepo Junction in Accra.

Legal analysts note that the appeal could have far-reaching implications for the ongoing legal and family disputes surrounding the late musician’s estate and marital status. Daddy Lumba’s personal life has continued to attract public attention, even after his passing.
