Keep Evidence of Helping Your Spouse Acquire Property – Lawyer Advises


 

Ghanaian legal practitioner Ernestina Obboh Botchwey, popularly known as Lawyer Tina, has advised couples and partners in relationships to keep clear evidence of their financial contributions—especially when acquiring property together.

According to her, such evidence becomes crucial when disputes arise after a breakup or divorce, as the courts rely on proof to determine ownership or contribution to jointly acquired assets.

“When things fall apart and one partner wants to recover what they invested, it is the evidence that will help them succeed in court. Without evidence, it will be very difficult for the courts to assist,” she explained.

Speaking on her YouTube channel, Ghana Law and More, Lawyer Tina encouraged individuals to make all financial contributions through traceable means such as bank transfers or mobile money, rather than cash payments.

“If you are acquiring property with someone—your boyfriend, husband, or wife—evidence is key. It is what will help you prove your contribution, maybe 10% or 20%. When the love ends, you can rely on that evidence to claim your fair share,” she advised.

She further urged individuals to include clear payment descriptions when transferring money electronically to serve as documentation of purpose.

“For instance, you can write ‘for building project’ or ‘for land payment.’ Don’t withdraw money and hand it over in cash. Use traceable platforms like mobile money or bank transfers and always include details,” she emphasized.

Citing a notable case, Ernestina Beateng v. Phyllis Serwah & Others, Lawyer Tina explained that even though the Supreme Court found that the plaintiff’s marriage was invalid, the court still awarded her a share of the property acquired during the relationship—because she was able to present evidence of her contribution.

She stressed that this case demonstrates the importance of documentation in protecting one’s financial interests in relationships and marriages.
