Sean "Diddy" Combs is seeking a retrial following a recent guilty verdict in which he was convicted on two counts of transportation for the purpose of engaging in prostitution.
Diddy’s legal team submitted the motion on Wednesday, approximately one month before his scheduled sentencing. The motion argues that the charges are a misapplication of the law, stating:
“Mr. Combs, at most, paid to engage in voyeurism as part of a ‘swingers’ lifestyle. That does not constitute ‘prostitution’ under a properly limited definition of the statutory term,” the filing reads, according to USA Today.
The defense further claimed that the individuals involved—primarily male escorts or dancers—were hired through legal businesses, compensated for their time, and maintained friendly relationships with both Diddy and other involved parties. They argue the individuals were not solely traveling to engage in sexual activity for payment.
Although Diddy was found guilty of transportation to engage in prostitution, the jury declined to convict him on more serious charges, including sex trafficking and racketeering.
Earlier this week, Diddy’s attorneys also submitted a new bond proposal, offering $50 million, agreeing to supervision by the U.S. Pretrial Services Agency, and surrendering his passport. The filing also referenced the controversial history of the Mann Act—the federal law under which Diddy was charged—describing it as a statute “rich with both racism and misogyny.”
If the guilty verdict stands, Diddy could face up to 20 years in prison. However, prosecutors have recommended a sentence of four years. His sentencing hearing is scheduled for October 3, 2025.
